General Terms and Conditions (AGB)
Validity of the GTC
These GTC apply to all orders, regardless of whether they are placed online, in writing or by telephone, unless otherwise agreed in writing. The version of the GTC published on the homepage at the time of the order shall apply. We reserve the right to amend the GTC at any time. Furthermore, the relevant provisions of the Swiss Code of Obligations shall apply.
Contract territory
The Swiss3D online store currently only offers delivery of goods in Switzerland and the Principality of Liechtenstein. For orders from other countries, additional shipping fees will be charged.
Delivery dates
Delivery dates may deviate from the stated deadlines depending on the place of delivery and are given to the best of our judgment. If deadlines are exceeded, this shall not entitle the customer to cancel the order or to assert claims for compensation, insofar as this is legally permissible.
Prices
The offer is valid while stocks last. All prices are quoted in Swiss francs. Prices are subject to change without notice.
Refund for non-printable models
If a submitted model cannot be printed due to technical limitations or for other reasons, Swiss3D reserves the right to cancel the order. In such cases, the customer will be refunded the full amount of the order. The customer shall be informed of the order cancellation and the reasons for it as soon as possible. The refund shall be made within a reasonable period of time to the means of payment used by the customer.
Forbidden objects
The customer is solely responsible for the content and objects that he submits for production. It is strictly prohibited to submit content and objects that violate applicable law, in particular weapons laws. Swiss3D reserves the right to reject orders that violate these provisions. Swiss3D may also take appropriate legal action.
Exclusion of liability for damage to health
Swiss3D accepts no liability for any damage to health that may result from the use of the products. The printed models are not food-safe and are therefore not suitable for contact with food or for medical applications. Small parts must not get into the hands of small children.
Conclusion of contract and withdrawal
All information on goods and prices on the Swiss3D website is subject to change and non-binding. By placing an order via the homepage, the customer submits a binding offer. If the goods ordered by the customer are not available in the desired quantity or at the price indicated on the homepage, Swiss3D shall notify the customer accordingly as soon as possible. In this case, the contract shall not be valid until the customer confirms the corrected order again by e-mail. Orders and agreements by telephone shall only be valid if they are confirmed in writing or by e-mail. In the event of typographical, printing and calculation errors on the homepage, Swiss3D shall be entitled to withdraw from the contract free of charge. Errors in the customer's delivered data (non-manifold, intersecting edges, etc.) shall entitle Swiss3D to withdraw from the contract free of charge.
Cancellation policy
Withdrawal is excluded for individually manufactured products. With standard products, a withdrawal can be made within 5 days, provided the goods are unused and in their original packaging.
Liability
Swiss3D shall not be liable for damages incurred by the buyer through the use or operation of the purchased items, to the extent permitted by law. Swiss3D assumes no liability for loss of profit or indirect or consequential damages that the buyer or third parties may incur, to the extent permitted by law.
Payment
Payment for ordered goods is made by Twint, credit card or invoice. Invoices must be paid within 14 days of the date of issue. If payment is not made, a payment reminder and a first and second reminder will be sent by e-mail. The claim will then be handed over to a debt collection agency.
Retention of title
The delivered products shall remain the property of Swiss3D until full payment has been made.
Copyrights and intellectual property
The customer assures that it holds all rights to the transmitted print data and does not violate any third-party rights. Swiss3D assumes no obligation to check.
Place of jurisdiction and applicable law
The place of jurisdiction is Solothurn, Switzerland. Swiss law shall apply exclusively.
